KENNEWICK, WA. — Washington State Patrol Trooper R. Morris reports that on Oct. 23, 2015 at 11:20 pm, a 1999 Buick Regal operated by Ty A. Moore, 31, failed to stop at a stop sign while southbound  on Rt. 397 at Bowles Road and collided with a 2010 Toyota Camry operated by Rosa E. Lemos, 21, of Kennewick.  Moore was injured and taken to the Kadlec Medical Center. DUI charges are pending.

Lemos was wearing a seat belt, was injured and taken by ambulance to Trios Medical Center.  Her vehicle was totaled in the crash.

A passenger in the Moore vehicle was killed in the crash. Fawn J. White, 34, of Hermiston, Ore., was not wearing a seat belt, report police. Her body was removed by the Benton County Coroner. Next of kin were identified, say police.

Also a passenger in the Moore vehicle was Beatriz Garcia Medina, 22, of West Richland. She was wearing a seat-belt and was taken to Trios Medical Center for treatment of her injuries.

 EAGLE, COLORADO —10/30/2015– Anthony Eugene Chase, 47, of Gypsum, Colorado was arrested Friday, October 23rd on charges of Vehicular Homicide, Reckless Driving, DUI and Tampering with Evidence for a July 23rd accident on Highway 6 in Eagle County that killed 29 year-old Sergio Ordonez-Morales.

Chase was released Friday on a $15,000 bond and he has a bond review hearing on November 17th at 9 am.

According to police reports Chase was allegedly driving a Mack truck westbound on Highway 6 near milepost #156 when the construction pumper truck crossed the center line at 5:21 pm and struck a White Chevy van driven by Ordonez-Morales. At 6:16 pm Ordonez-Morales was pronounced dead at the Vail Valley Medical Center from injuries received as a result of the crash.

“The regularity of crashes resulting in death that involved intoxicated drivers is disturbing,” said District Attorney Bruce Brown. “The charge here is very serious and could result in a lengthy prison sentence,” Brown added.

There are several recent and pending cases involving vehicular homicide / assault in the Fifth Judicial District including:

• June 2015 – Hugo Castillo-Marquez of Avon, Colorado was sentenced to two years in the Department of Corrections for vehicular homicide in the death of a local woman who was a passenger in Castillo’s car on August 21, 2014.

• May 2015 – Emanuel Villeda of Pueblo was sentenced to twelve years in prison for vehicular homicide / DUI in connection with a June, 2014 crash that led to the death of one man and the paralysis of another.

• February 2015 – Michael Glass was sentenced to five years probation and a jail term of three-hundred and sixty days for injuring a pedestrian and leaving the scene of an accident in Avon on December 9, 2013 that left the victim with a compound leg fracture.

Pending Cases:

• Steven Gravatt, 55, of Blue River, Colorado was charged in September for the hit-and-run death of a woman in Breckenridge in late August 2015. Gravatt has a preliminary hearing on November 4th @ 1:30 pm;

• Hallie Schmitt, 25, of Dillon was charged with vehicular assault related to a hit-and-run accident in Breckenridge in December 2014. Schmitt has a motions hearing on November 23 @ 11 am;

• John Althouse, 34, of Vail pleaded guilty to vehicular homicide (reckless driving) and driving under the influence (DUI) in September. Althouse was sentenced to 6 years in DoC with five years suspended and one-year mandatory parole.

Note: All persons charged with crimes are presumed innocent until the contrary is proven in a court of law.

Reno, Nevada  10/30/2015 —Washoe County District Attorney Chris Hicks announced August 21, 2015 the sentencing of a Reno man on a charge of DUI causing death to a maximum prison term of 20 years for the June 2014 death of a 16 year old local high school student bicyclist.

Jesse Michael Todd, 52, (DOB 12/5/62), was charged with one count of Driving Under the Influence Causing Death for the June 13, 2014 death of the victim, who was riding his bike along Seneca Drive in Lemmon Valley at approximately 9:00 pm.  The Washoe County Sheriff’s Office investigation into the accident determined that Todd was under the influence of alcohol, speeding, and crossed over the center line into the oncoming travel lane when he crashed into the boy.

A Jack Daniels whisky bottle discarded by the defendant was found at the scene and investigators estimated Todd’s blood alcohol level was .159 at the time of the accident. The minor, who had just finished the last day of his sophomore year at North Valley High School, was transported to a local hospital where he died of his injuries.

Todd plead guilty to the charge in July of this year and was sentenced earlier today in Washoe County District Court by the Honorable Judge Lidia Stiglich. He will be eligible for parole after 8 years.

District Attorney Chris Hicks commented, “This case signifies the dangers and resulting tragedies of drunk driving.  It should serve as a reminder, that it is never a good idea to get behind the wheel after drinking.”

MEMPHIS, Tenn. 10/30/2015— The driver of a Dodge Avenger involved in a crash Tuesday evening that killed one person and sent two others to the hospital is facing multiple charges.

Police arrested Andrew Morris, 45, on Wednesday. He is charged with aggravated assault, aggravated vehicular homicide, driving under the influence, driving while license suspended, DUI – child endangerment, failure to exercise due care, open container and violation of seat belt law.

Morris was driving westbound on Winchester Road and turned left toward a private driveway when a UPS truck traveling eastbound on Winchester struck his vehicle on the passenger side, according to the affidavit.

The front right passenger died at the scene from her injuries, and the rear right passenger was transported to Regional Medical Center ...MORE

CEDAR HILL, TN (10/30/2015) –The parents of a teen killed in a crash in Robertson County have a warning for other young people.

 Landon Ross, 17, passed away when his pick-up truck went off Flewellyn Road and hit a tree Saturday night.

A preliminary report by the Tennessee Highway Patrol claims drugs and alcohol were involved in the crash and Landon Ross was not wearing a seat belt, though the cause of the crash is still under investigation.

“We know where Landon is right now,” said Dell Ross, Landon Ross’s mother. “We’re in the peace that he’s in heaven with the one person who loves him unconditionally, and that’s Jesus Christ.”

David and Dell Ross of Cedar Hill said the values they’ve instilled in their three sons start with the importance of a strong work ethic and church.

“If you didn’t get in here to church, you were going to be home all day Sunday,” said Dell Ross, sharing the family rules.

Family members said Landon Ross lived by those values. His family said he worked hard at Pleasant View Feed Mill, studied hard at Springfield High, but all the while, had the quick wit to know just what to say to get the room laughing.

“To hear people talk about Landon, those words of how he was away from home have been a blessing to me,” said Dell Ross.

“Far as we know, he was looking off, distracted for whatever reason,” said David Ross, Landon’s father, referring to the crash. “That’s a big thing these days, distracted driving. Do not make the mistake of letting peer pressure cause you harm. Life’s precious, and it’s short. Impaired Motorist Who Killed and Injured Passengers in South Lake Tahoe Collision Pleads No Contest to Gross Vehicular Manslaughter and Driving Under the Influence Causing Gross Bodily Injury

According to the County of El Dorado District Attorney, a driver impaired by alcohol who caused the death of one passenger and  great bodily injury to another passenger in a high speed solo vehicle collision in South Lake Tahoe pleaded no contest to all charges filed by the El Dorado County District Attorney’s Office.

The driver, Olga Pena-Arce, 20, of South Lake Tahoe, pled no contest on September 14th to gross vehicular manslaughter while intoxicated (Penal Code section 191.5 (a)), driving under the influence causing injury (Vehicle Code §23153(a)) and driving with a blood alcohol level of greater than .08% causing injury (Vehicle Code section 23153(b)) in front of South Lake Tahoe Superior Court Judge Suzanne N. Kingsbury.  Pena-Arce also admitted special allegations that she personally inflicted great bodily injury on a passenger, and that she killed or injured more than one person.  The collision, which took place on November 24th , 2014, took the life of passenger Aimee Campos, 21, of South Lake Tahoe, and injured passenger Wayne Walker, 25, of Sacramento.  Pena-Arce will be sentenced in Department 3, El Dorado County Superior Court on November 13th, 2015.

The case was investigated by the South Lake Tahoe Police Department, the California Highway Patrol Multidisciplinary Accident Investigation Team (MAIT) and El Dorado County District Attorney’s Office.  Deputy District Attorney Michael P. Pizzuti, who prosecuted the case, said the maximum possible sentence for the offenses is 12 years, 8 months state prison. Deputy District Attorney Pizzuti is assigned to vertically prosecute felony driving under the influence cases and vehicular manslaughter cases for the El Dorado County District Attorney’s Office under a traffic safety grant from the California Office of Traffic Safety.

10/30/2015  — South Lake Tahoe, Calif. On June 15, 2015, El Dorado County Superior Court Presiding Judge Suzanne Kingsbury sentenced 28 year old Megan Hickel to a state prison sentence of 12 years for killing victims Richard Schwab, 48 and Kelly Christine Schwab, 49, both of Dixon, California.

Hickel pled guilty to two counts of Penal Code section 191.5 (a), gross vehicular manslaughter while intoxicated.
On the evening of July 4th 2014, after viewing a Fourth of July fireworks display in South Lake Tahoe, Richard Schwab and his wife Kelly Schwab were returning home to Dixon on Highway 50 when their motorcycle was struck in a cross-over collision by Hickel’s vehicle going in the opposite direction in the Twin Bridges area. The Schwabs were killed instantly.

The case was investigated by the California Highway Patrol, California Highway Patrol MAIT (Multi-Disciplinary Accident Investigation) Team and El Dorado County Sheriff’s Office. Deputy District Attorney Michael P. Pizzuti, who prosecuted the case, said the confinement time was the maximum allowed by law because Hickel had no prior criminal record. Deputy District Attorney Pizzuti is assigned to vertically prosecute felony driving under the influence cases and vehicular manslaughter cases for the El Dorado County District Attorney’s Office under a traffic safety grant from the California Office of Traffic Safety.

Kelly Christine Schwab killed by drunk driver South Lake TahoeRick and Kelly Schwab, beloved parents and grandparents, passed away tragically on July 4, 2014 when they were hit on their motorcycle by a drunk driver.
Rick was born in Union City, Pennsylvania on October 15, 1966 to Joseph and Delores Schwab. Kelly was born in La Mesa, California on November 12, 1965 to James Anthony and Beryl Bridges.
Both served proudly in the U.S. Air Force. Rick was passionate about music, whether playing in a band or just listening. Kelly was larger than life and was passionate about photography. Rick and Kelly were rarely apart and loved spending time with family and friends. They enjoyed camping, going to concerts and especially doting on their grandchildren.
They are survived by their 3 children, Larrisa(28), Derrek (26)(Ally) and Jared(14); grandchildren, Lila Belle(4) and Zacharry (2); Rick’s mother, Jean; Kelly’s mother, Beryl; Rick’s sister, Sharon (Jacob) and Kelly’s brother, Todd (Katie); Survivors also include numerous extended family and countless friends.
A Memorial Service will be 10:00 A.M. Thursday, July 17, 2014 at Valley Church 5063 Maple Road in Vacaville. A Graveside Service will follow at 1:30 P.M. at Sacramento Valley VA National Cemetery in Dixon where they will both receive military honors. A Celebration of Life will be at 5:30 P.M. at the Dixon American Legion 1305 N. 1st Street in Dixon.

10/30/2015  — Prosecutors with District Attorney Charme Allen’s DUI Unit obtained a conviction on Oct. 16, 2015 for a crash in which the passenger of the impaired driver lost his life. Joyce Darlene Scott, 50, pled guilty to Aggravated Vehicular Homicide and was sentenced to serve eighteen years in the Tennessee Department of Correction. Scott had two prior convictions for DUI at the time of the crash.

Assistant District Attorney Joe Welker outlined the State’s case in a hearing before Judge Scott Green. Welker explained to the Court that on November 8, 2013, Knoxville Police Department Officer Tim Edwards responded to a single-vehicle crash at 2622 Texas Avenue. Rural Metro also arrived and transported Scott to UT Medical Center, but the passenger, Norman Connaster, was pronounced dead at the scene. Ofc. Edwards was able to determine based on evidence at the scene that the vehicle driven by Scott left the roadway and struck a utility pole before rolling on its side, sliding through a fence, hitting an embankment, and ultimately, striking an auto parts store at 2622 Texas Ave.

Scott was interviewed and admitted consuming alcohol prior to the crash. She told officers she swerved to avoid hitting an animal in the road, and she lost control. Scott’s blood was drawn after the crash and showed that in addition to alcohol, Scott had cocaine, prescription pills, and marijuana in her system.

“This is yet another tragic example of the danger of impaired driving,” said DA Allen. “My Office spends a great deal of effort prosecuting DUI cases in the hope that strict enforcement and aggressive prosecution may help prevent outcomes like the one in this case.”

The case was enhanced to Aggravated Vehicular Homicide, a Class A felony, because the Defendant has two prior DUI convictions on her record from 2002 and 1998.

DUI Driver Responsible For Head On Collision Resulting In Great Bodily Sentenced To Eight Years In Prison

Santa Rosa, CA  –  October 31, 2015  –  District Attorney Jill Ravitch has announced that on October 22, 2015 defendant Juan Banda Jr., 22-years-old of Santa Rosa, was sentenced by the Honorable Gary Medvigy to eight years in state prison for driving under the influence of alcohol and causing great bodily injury.

District Attorney Ravitch stated, “Despite his young age, Banda is no stranger to the criminal justice system.  His actions in this case and his past conduct completely justify a lengthy prison term.”

On September 2, 2015 Banda pled no contest to a felony violation of driving under the influence of alcohol resulting in great bodily injury, and driving without a valid license.  He also admitted enhancements for having previously been convicted of a serious and violent felony as well as having served a prior prison term.

The crash occurred when the vehicle Banda was driving north-bound on Valley Ford Road crossed into oncoming traffic.  The passenger of the vehicle Banda struck was able to quickly escape.  However, the driver was trapped for an hour before being safely extricated by emergency personnel.

The driver sustained major injuries that included multiple bone fractures and severe lacerations.  Banda was observed after the crash displaying signs consistent with alcohol impairment, and a subsequent test confirmed the presence of alcohol in his blood.

Repeat DUI Offender Sentenced to Prison for DUI and Child Endangerment

Santa Rosa, CA  –  September 2, 2015  –  District Attorney Jill Ravitch has announced that defendant Martin Reyes Rosales, 32-years-old of Cloverdale, was sentenced Tuesday by the Honorable Patrick Broderick to four years in state prison.  Rosales had previously pled no contest to three felony offenses for child endangerment and one misdemeanor offense for driving with a blood alcohol concentration of 0.08 percent or more.  Along with his no contest plea to three felony and one misdemeanor offenses, Rosales also admitted that he has two prior DUI convictions within the past 10 years, both committed here in Sonoma County.

District Attorney Ravitch stated, “This defendant has repeatedly endangered the citizens of Sonoma County by driving impaired.  Here, the defendant was impaired, speeding, and doing so with his young children unrestrained in the car.  We are pleased that the court has imposed a prison sentence.”

The charges resulted from an incident in Healdsburg on August 15, 2014, when Rosales was pulled over for speeding on Alexander Valley Road.  Rosales’s vehicle was paced by the Healdsburg police officer traveling approximately 70 mph in a 45 mph zone.

When the arresting officer walked up to the vehicle and contacted Rosales, he saw Rosales’s three young children sitting unrestrained in the front seat.  The children ranged in age from 4 to 11.

None of the children were wearing seat belts, let alone proper child safety seats.  Rosales displayed objective signs of being under the influence of alcohol, and a subsequent breath test revealed his breath alcohol concentration to be 0.18 percent.  At the time of his arrest, Rosales was on misdemeanor probation for a similar offense during which he was driving under the influence of alcohol with one child not properly restrained.

The case was prosecuted by DDA Matthew Henning of the District Attorney’s Vertical DUI Unit.  Funding for this program was provided by a grant from the California Office of Traffic Safety, through the National Highway Traffic Safety Administration. The Healdsburg Police Department headed the investigation.

Parole Denied In 2001 DUI Death

Santa Rosa, CA  –  October 9, 2015  –  District Attorney Jill Ravitch attended the parole hearing for Christopher Peter Kazas, 33, at Soledad State Prison on September 29, 2015.  Ravitch was the prosecutor at the jury trial in 2002, where a jury found Kazas guilty of trying to evade a CHP officer and murder.

In his effort to outrun the officer, Kazas ran a red light and broadsided a van driven by Michael Bireschi, who was killed, and then fled the scene.  Bonita Bireschi was injured in the collision.  She attended the parole hearing along with her daughter.  The Parole Board found that Kazas continued to present an unreasonable risk to public safety and issued a five year denial.

District Attorney Ravitch noted that Kazas referred to the incident as an accident when he was sentenced, and denied he was a murderer.  At the parole hearing, while never facing the widow, Kazas acknowledged his role in the death and the pain he had inflicted upon so many.

Nonetheless Kazas’ conduct while incarcerated indicated to the board that he still lacked insight into the nature of his criminal behavior, and was unable to adhere to rules, regulations and laws.

Mrs. Bireschi was unable to address the board at the hearing, overcome by emotion after her daughter spoke of the wonderful man who had been killed, and of all who missed him, as well as all he missed as children were born and wed.

“Chris Kazas committed a very selfish act when he chose to drink and drive on April 22, 2001,” said Ravitch.  “He knew from prior DUIs how dangerous his conduct was, but drove anyway and then tried to outrun a law enforcement officer, putting everyone on the road at risk.  His failure to take responsibility was echoed in his misconduct in prison, and his words to the parole board, suggesting he had served enough time for the damage he caused.  The parole board disagreed with his suggestion, and he will have five more years to think about what he did and who he will be when he is released.”

CHP Officer Wayne Ziese said Kazas ran from his truck after the crash but was apprehended nearby. Ziese said Kazas has a history of drunken driving and was booked into Sonoma County Jail.

Repeat DUI Offender Sentenced To Prison For DUI Causing Injury

Santa Rosa, CA  –  October 16, 2015  –  District Attorney Jill Ravitch has announced that defendant Francisco Sanchez Delgado, 35-years-old of Cloverdale, was sentenced Thursday by the Honorable Gary Medvigy to five years in state prison.  Delgado had previously pled no contest to one felony offense for DUI causing injury and admitted a special allegation that he caused great bodily injury to the victim.  Delgado also admitted that he had one prior misdemeanor DUI conviction from May of 2009.

District Attorney Ravitch stated, “This defendant made the decision to endanger the lives of multiple people by driving impaired.  By sheer luck he did not kill the victim in this case.  Here is an individual that has been warned directly by the court in the past that he could be charged with murder for killing someone during the course of a DUI, and he still chose, on two additional occasions, to get behind the wheel intoxicated.  He is dangerous, and the prison sentence is appropriate.”

The charges resulted from an incident on April 21, 2015, when Delgado caused a head-on collision on Highway 12 at Dunbar Road.  As a result of the car accident, the victim suffered a broken foot.  Minutes before the collision, Delgado had been seen driving the wrong way by a separate driver who was able to pull off the road in time to avoid a collision.

That driver called 911 to report Delgado, but police officers were unable to respond before Delgado ultimately collided with the victim.  When officers responded to the scene and contacted Delgado, they observed objective signs of alcohol intoxication. A blood test was conducted and Delgado’s blood was found to contain 0.13 percent alcohol.  At the time of his arrest, Delgado was pending charges on yet another DUI from an incident that occurred in January of 2015.

The case was prosecuted by DDA Christopher Brown of the District Attorney’s Vertical DUI Unit.  Funding for this program was provided by a grant from the California Office of Traffic Safety, through the National Highway Traffic Safety Administration. 11/01/2015  -Charleston County Deputy Coroner has said that the passenger has died after the car she was in flipped over on Seabrook Island Road near Jenkins Point.

The victim has been identified as 27 year old Jessica Hoisington.

The Coroner says that she died at MUSC on Oct. 30, 2015 from injuries sustained during the crash.

The Charleston County Sheriff’s Office arrested the driver Matthew Paul Hoisington and charged him with a felony DUI.

Just after midnight on Friday, deputies responded to a single car collision on Seabrook Island Road and Jenkins Point.

CCSO officials say the vehicle, driven by Matthew Hoisington, ran into a tree before overturning.

Both the driver and the passenger were transported to MUSC.

11/02/2015 — Also according to police:  Luis Lopez was driving a 2002 Chevrolet Silverado west on Lake Mead Boulevard approaching Mount Hood Street about 8:20 a.m. and failed to stop at a red light, striking a southbound 2006 Ford Mustang at the intersection. The Silverado then struck a 2014 Honda Odyssey, and debris from the crash hit an eastbound Chevrolet Impala.

The Mustang’s driver was killed, while passenger Tyki Sato, 30, of Las Vegas suffered serious injuries. The Odyssey’s driver, Conrado Mas, 53, of Las Vegas, suffered minor injuries, and the Impala’s driver, Santiago Manrique, 45, of Las Vegas, was not injured.

Khalil Tiner, 26, who was driving the Mustang died at the scene. Three others were sent to the hospital with non-life threatening injuries.

PORTLAND, ORE. Portland Police Bureau reports that on Sunday November 1, 2015, at 1:01 a.m., North Precinct officers responded to North Lombard Street and Peninsular Avenue on the report of a single vehicle crash into a power pole.

Officers and medical personnel arrived and located the crashed green 1999 Ford Explorer on the northwest corner of the intersection with the driver still in the vehicle. A second person, initially thought to be a passenger in the vehicle, was found deceased and lying in the westbound lanes of the intersection.

Officers quickly learned that the second person, a 27-year-old male, was a pedestrian struck by the driver approximately one block to the East of the crash.

Officers observed signs of impairment on the driver, 21-year-old Mathew Tyler Freeman of North Portland, and learned from witnesses that Freeman was driving at a high rate of speed westbound on Lombard prior to striking the victim and crashing.

Investigators from the Traffic Division’s Major Crash Team, Criminalists from the Forensic Evidence Division as well as a Deputy District Attorney from the Multnomah County District Attorney’s Office responded to the scene.

Freeman was arrested on charges of Manslaughter in the Second Degree, Criminally Negligent Homicide, Recklessly Endangering Another Person, Reckless Driving, and Driving Under the Influence of Intoxicants.

Freeman was booked into the Multnomah County Jail and will be arraigned on Monday.

CHESAPEAKE BEACH, MD. — Two people operating a tandem bicycle in Chesapeake Beach were run down and killed by a drunk driver, reports Calvert County Sheriff Mike Evans.

The police report that on October 31, 2015, at 2:57 p.m. , deputies responded to the area of Tobacco Rd and Tobacco Lane, Chesapeake Beach in Calvert County, Maryland about a crash involving a motor vehicle and bicyclists.

Police report that Lyon at first attempted to pedal a fantasy that she was driving along with she saw these two people in trouble on the side of the road. Then she admitted to having had a few cocktails. Before long, she was behind bars. Police said the two victims were John Henrik Fauerby, 64, and Lynne Frances Rosenbusch, 58, both of Clarksburg, Md.

They were operating a tandem bicycle northbound on Tobacco Rd. A 2014 Jeep Grand Cherokee, being operated by Catherine Frances Lyon, 62, of 4065 Weeping Willow Lane, Huntingtown, Md., was also traveling northbound on Tobacco Rd. The Jeep came up from behind the bicycle and struck it in the rear. As a result of the collision, both Fauerby and Rosenbusch were ejected from the bicycle. Due to the injuries from the collision, Rosenbusch was pronounced deceased on the scene by medical personnel. Fauerby was transported to Calvert Memorial Hospital where he succumbed to his injuries.

Police say that Lyon was operating the Jeep under the influence of alcohol. Lyon was arrested and charged with multiple traffic and criminal charges including Driving under the Influence and Homicide by Motor Vehicle While under the Influence.  Lyon was transported to the Calvert County Detention Center to await a hearing before the District Court Commissioner.

NBC 4 News in Washington, D.C. reported that Rosenbusch’s sister, Arlene Rosenbusch, said Lynn Rosenbusch was so badly injured authorities had a hard time identifying her.

“They couldn’t tell it was her until they saw her I.D.,” Arlene Rosenbusch said, adding that her sister and brother-in-law were “a special couple devoted to each other.”

Corporal Thomas Phelps and other members of the Crash Reconstruction Team are conducting an investigation of the collision.  Anyone with information about the collision is asked to contact Cpl. Phelps at 410-535-2800.

Lyon was charged with four counts of negligent homicide under the influence.  She was jailed on Oct. 31, 2015 and released from jail on Nov. 1, 2015 on $200,000 property bond. She appears in court

On Oct. 23, 2014, Lyon was charged with assault, intoxicated endangerment and disorderly conduct in District Court for Calvert County. With attorney Thomas Axley representing her in a plea deal with the Calvert County States Attorney on Dec. 29, 2014, all charges were put on the Stet Docket with no fine and no time.

WUSA9 News reported Lyon’s blood alcohol level was .12.

LAKEWOOD, Colo. 11/03/2015 — A passenger was killed, and the driver and another passenger were hospitalized after a car crash on Sixth Avenue early Monday morning.

It happened in the eastbound lanes just before Sheridan Boulevard when the driver lost control and hit the guardrail, rolling several times, according to the Lakewood Police Department.

A driver and two passengers were in the vehicle. One passenger was ejected and pronounced dead at the scene. Police identified her as 19-year-old Kayla Ann Flinchpaugh. Officials said she died as a result of significant head trauma.

The male driver was thrown from the vehicle but suffered non-life-threatening injuries. He remains in the hospital.

Another female passenger was injured during, but Lakewood police said she was wearing her seat belt. Identities of the driver and third passenger have not been released.

11/03/2015 — A Smithton man whose girlfriend died from injuries suffered last year in a South Huntingdon crash is charged with homicide by vehicle while driving under the influence.

Ryan Joseph Denitti, 19, of Second Street was arraigned Monday in Rostraver by Magisterial District Judge Charles Christner on charges related to the crash that resulted in the death of MacKenzie Marie Wyant, 18, of Herminie.

State Trooper Marc Ziegler of the Belle Vernon Barracks also charged Denitti with aggravated assault by vehicle while DUI; homicide by vehicle, DUI-general impairment; DUI-high rate of alcohol; DUI-alcohol or controlled substance; recklessly endangering another person; underage drinking and several traffic violations.

State Trooper Marc Ziegler of the Belle Vernon Barracks also charged Denitti with aggravated assault by vehicle while DUI; homicide by vehicle, DUI-general impairment; DUI-high rate of alcohol; DUI-alcohol or controlled substance; recklessly endangering another person; underage drinking and several traffic violations.

According to an affidavit of probable cause, Denitti failed to negotiate a left curve while heading west 4 a.m., Oct. 26, 2014, on Turkeytown Road.

The vehicle reportedly struck a fallen tree, went airborne and hit another tree, causing the vehicle to spin counter-clockwise and roll onto its passenger side.

Witness, Allan Clark, 18, of Dongilli Park Lane, Rostraver, told Ziegler he came upon the crash scene, the affidavit states.

Clark said Denitti asked for help and wanted him to take Wyant to a hospital. Clark said he cradled Wyant with his arms, removed her from the backseat of the wreckage and put her in the backseat of his vehicle.

11/05/2015 — A pedestrian was killed on Sunday around 7:50 p.m. after being hit by a vehicle on Apple Grove Road in Morgan County.

State troopers said Daniel Lee Sharp, 35, of Lacey’s Spring, was hit and killed by a 1988 Chevrolet van driven by Jeffrey Jason Kelley, 38, of Arab.

Sharp was pronounced dead at the scene. Kelley was not injured.

The crash happened five miles south of Lacey’s Spring.

Sam Ellis will face double DUI rap for deaths of Calvin Li and Alex Murk

ROCKVILLE, MD. — Samuel Joseph Ellis has been indicted by a Montgomery County Circuit Court Grand Jury on seven counts of negligent manslaughter, negligent homicide and causing life-threatening injury for killing Alex Murk and Calvin Li,  two of his high-school friends in a DUI crash in North Potomac last June.

Ellis faces Judge John W. Debelius III on Nov. 20, 2015 for a scheduling hearing.  A video bench warrant hearing was held on Nov. 6, 2015 at 1:30 pm before Judge Cynthia Callahan. Ellis, of 14609 Snapdragon Circle in North Potomac, Md.,

Ellis also faces a criminal hearing on Nov. 18, 2015 in Ocean City from charges brought by Ocean City Police Officer R. Flanagan for being involved in a fight on June 2, 2015. A civil citation for possession of alcohol under the legal age on March 15, 2015 was dropped by Montgomery County States Attorney John McCarthy on June 9, 2015.

Kenneth Saltzman, a parent who was at the party on 14600 Boat House Way in North Potomac, and whom hosted the teen party, was charged on Oct. 28, 2015 with furnishing alcohol to a minor. He faces trial in District Court for Montgomery County on Dec. 10, 2015.

ROCKVILLE, MD. — The driver who police say killed two of his passengers while on a high-speed booze cruise after a teenage drinking party was busy racking up a record of alcohol and fighting in two Maryland counties in recent months.

While Samuel Joseph Ellis, of 14609 Snapdragon Circle in North Potomac Maryland rests up in his hospital bed from injuries which were apparently self-inflicted by his reported speeding into the grounds of a home after a teen drinking party; an examination of his court record shows a civil citation for underage possession of alcohol was served on him by Montgomery County Police Officer N. Culler on March 15, 2015.

The incident of underage alcohol was just three months prior to the fatal crash in which police say he killed two of his school chums. Dead are Alexander Murk and Calvin Jaixing Li, both recent graduates of Wooten High School.

On June 9, 2015, the Montgomery County States Attorney John McCarthy dropped the citation, which carried no criminal record but did have a fine payable of $100.  The court record doesn’t show any public service assessed in lieu of the fine.

On June 2, 2015 the party boy Sam Ellis was reveling in Ocean City, Maryland along with thousands of other newly graduated high school students when he was arrested by Ocean City Police Officer R. Flanagan.  The criminal charge which is pending in Worcester County District Court for a hearing on July 9, 2015 is for the criminal charge of “affray”, which means participating in a fight among several persons, often associated with a riot or rumble.

Arrested at the same time as Ellis was one of the teens who died in the crash, Calvin Jaixing Li, of 2326 McCormack Rd. in Rockville, Md. The pair were charged by Ocean City Police in a June 2, 2015 2:27 am incident which took place at 6007 Coastal Highway.

Court records show that Rockville attorney Brian Clark represented Li and has filed an order with the Worcester County District Court on June 29th for abatement of the charge due to Li’s death.

Montgomery County lawyer and former Delegate Robin Ficker made this comment on aWashington Post article about the double fatal teen crash:

“Just this past week in Montgomery County Circuit Court, Vincent Olalo was sentenced to 3 years in jail by Judge Mason because his drunk driving accident contributed to the death of a man who already had very serious health problems. Let’s see if States Attorney McCarthy administers justice even-handedly.”

NORTH POTOMAC, Md. Sept. 22, 2015 – (WUSA9) — The family of one of two 18-year-old Wootton High School graduates killed in a car crash after a party released a statement Monday expressing shock about the news a parent was present for the party, and a desire to make sure the laws change.

The statement by David and Pamela Murk comes days after a WUSA9 report into the investigation into the crash that killed their son Alex Murk and fellow Wootton graduate Calvin Li on June 25. The two were killed after the car they were traveling in flew into a fence, hit a tree and landed in a yard.

According to documents obtained by WUSA9, the driver of the car, Sam Ellis, was traveling at least more than 30 miles above the speed limit and has a blood alcohol content of .09 two hours after the crash.

“Needless to say, this has been a lot — almost too much — for us to absorb. The details into what happened that night re-opens fresh wounds and our family is absolutely devastated,” David and Pamela Murk said in the statement.

The two also expressed disgust at the circumstances at the party, specifically the knowledge that a parent was present at the party. According to sources, Kenneth Saltzman knew about the party his daughter was hosting, and at one point jokingly asked a partygoer if one of the 30-packs of beer they brought was for him.

Salzman is expected to be charged with adult responsibility, but the Murks believe punishment associated with that charge is too little.

“What is even more shocking is the fact that under Maryland law, a first offense for behavior such as Mr. Saltzman’s carries no jail time, but merely a maximum fine of $2500,” the Murks said in the statement. “$2500 for something that results in the death of two young men.”

The two also call for a change to the laws, specifically the potential punishments that can be held against drivers.

“Slaps on the wrist, or short jail sentences, will NOT deter other teenagers from acting as grossly irresponsibly as Sam Ellis did that night,” the Murks said in the statement.

“It goes without saying, we were extremely disappointed that so many family and friends of Alex and Calvin within our community who had knowledge of what took place that evening, were unwilling to come forward without subpoenas and a Grand Jury proceeding,” the Murks said in the statement.

Birmingham, Alabama – 11/09/2015 — A Blount County assistant district attorney has resigned after she was arrested for her involvement in a DUI crash with injuries.

Birmingham police arrested Lindsay Nadeau early Saturday morning. Birmingham City Jail records show she was booked into the jail after the 1 a.m. crash, and released later that day.

Blount County District Attorney Pamela Casey said Nadeau immediately resigned from her job. “As the Blount County District Attorney, I take very seriously my responsibility to promote public safety by prosecuting those individuals who commit crimes in our community,” Casey said. “My employees understand that, like myself, they are public servants and that the public’s expectations are much higher for us given the work that we do.”

The crash happened about 1 a.m. Saturday. Birmingham police said an officer on patrol drove up on a wrecked vehicle at Oporto Madrid Boulevard South and Cooper Hill Road. Nadeau, said Sgt. Bryan Shelton, was in the driver’s seat of a vehicle that had struck a utility pole. LAKELAND — Timothy Alan Lundy, 58, of Hunters Run Boulevard in Lakeland, was arrested Sunday in connection with the Friday night fatal crash that killed David McCausland.

Polk County Deputies have charged Lundy with vehicular homicide, DUI manslaughter and DUI with serious bodily injury.

Deputies charge that Lundy was driving the Corvette that caused a four-vehicle crash about 6:10 p.m. on Marcum Road that threw 70-year-old McCausland of Lakeland from his Ford F150.
