JAIL IS THE ONLY PUNISHMENT THAT KEEPS HABITUAL DWI DRIVERS OFF THE ROAD…

Ride with an impaired driver, buy a ticket to your own funeral

From Mooresville Tribune:

A Mooresville man with more than a half-dozen previous driving-while-impaired convictions is now facing a manslaughter charge from a crash earlier this month that claimed the life of his 34-year-old passenger.

Bradley Stephen Rose, 43, of Laura Road, Mooresville, was arrested Aug. 14 for manslaughter, reckless driving, driving while license is revoked, failure to wear a seat belt and failure to maintain lane control. His bond was set at $100,000.

Trooper D.K. Ayers of the N.C. Highway Patrol said Jennifer Rae Ryals, 34, was killed in the Aug. 5 crash on Rankin Hill Road. Rose, he said, was operating a vehicle that ran off the road and struck a tree.

Ryals and Rose were airlifted to Carolinas Medical Center in Charlotte, where Ryals died from her injuries. Rose was hospitalized for about a week and was arrested upon his discharge from the hospital, Ayers said.

Ayers said Rose was driving on a permanently suspended license, which had been revoked for driving-while-impaired convictions. He said Ayers had been convicted twice of habitual DWI. ….MORE

Sonoma County Ca DUI Gonzalez 100 mph 3 patrol cars damaged, 2 deputies hurt 082214

Sonoma County Ca DUI Gonzalez 100 mph 3 patrol cars damaged, 2 deputies hurt 082214

Santa Rosa, Calif. According to Sergeant Cecile Focha of
the Sonoma County Sheriff’s Department, on August 22, 2014 at 12:25AM, a Sonoma County Deputy Sheriff was on routine patrol travelling southbound on highway 101 near the Hearn Avenue onramp, Santa Rosa. His attention was drawn to a silver Audi wagon passing him well over 100 MPH.The Deputy got behind the vehicle and turned on his lights and siren. The driver initially braked and slowed slightly, but then stepped on the gas and sped up well over 100 mph again. The driver was driving completely recklessly and with no regard for anyone else on the road. The car needed to be stopped before the driver hurt someone. The car took the Todd Road exit, where there just happened to be another Deputy headed toward them. That Deputy made a U-turn and joined in the pursuit. The driver took a series of strange turns, at time more than doubling the speed limit. He covered about 10 miles in ten minutes through South Moorland, Langner, Millbrae, Labath, Golf Course, Whistler, Stony Point, and others with eventually getting back to Todd Road. He ran at least ten stop signs and at least one red light. Fortunately there was very little traffic on the roads at the time. More Deputies responded to the chase to take positions so that the car could no longer flee.

As the driver headed east on Todd Road, he encountered more patrol cars. He spun his car around and crashed. He was stopped parallel to a patrol car with two more facing him. He revved the engine and plowed head-on into a stopped patrol car. He was then boxed-in on all side by patrol cars, thus ending the chase.

As the Deputies approached the suspect vehicle and saw the driver laughing and smiling and then quickly reach between his legs. Deputies had to break out a window to remove him from the car and take him into custody.

JUSTIN STEVEN GONZALES , 36 years old from Santa Rosa, was take to the Sonoma County Jail and booked for violation of : 245(a)(1) Assault with a Deadly Weapon, 1203.2 PC- Violation of Probation, 2800.2 VC- Evade a Peace Officer with Wanton Disregard, and 14601 VC Unlicensed Driver.

Since the Deputies suspected he could be intoxicated they asked that the District Attorney file a complaint on 23152(a) VC Driving Under the Influence.

Gonzales totaled his car, damaged three patrol cars and injured two Deputies.

Gonzales produced Bail in the amount of $31,000 and is scheduled to appear in court on August 27 at 8:30AM.

A habitual drunk driver from Valdese will serve up to five years in prison.

Delphia Renee Whisnant Sumpter, 44, of Valdese, was convicted this week of two felony counts of habitual driving while impaired and felony possession of a firearm by a convicted felon. She was sentenced to between 3.3 years and 5.5 years in state prison.

The District Attorney’s Office says the first habitual driving while impaired incident happened in February 2014 in Granite Falls.

Officers there got a call from a concerned resident about a possible impaired driver on U.S. 321 and officers found Sumpter operating a vehicle while subject to an impairing substance, according to the District Attorney’s Office.

The second habitual driving while impaired incident happened in June 2014 in Lenoir. Officers got a CrimeStoppers tip about a possible impaired driver and found Sumpter operating a vehicle while subject to an impairing substance, according to the District Attorney’s Office.

Sumpter previously had been convicted of driving while impaired on Dec. 15, 2008, in Caldwell County, Aug. 2, 2012, in Caldwell County and Feb. 5, 2013, in Burke County, the D.A.’s Office says. California: Judge for Perla Ibeth Vazquez in death of Frank Winslow: 15 years in prison

She told the judge she didn’t commit murder — the judge told her YES YOU DID!

Admitting responsibility for the death of a Clovis family man, 27-year-old Perla Ibeth Vazquez told a packed courtroom Tuesday that she wanted to be held accountable for her actions, but insisted: “I am not a murderer.”

Her plea didn’t sway Judge Hilary Chittick.

“This was a murder,” Chittick said bluntly in Fresno County Superior Court before sentencing Vazquez to 15 years to life in prison for getting drunk and causing a crash on Highway 168 in Fresno that killed 54-year-old Frank Winslow in October 2011.

Chittick said a jury was correct last month when it found Vazquez guilty of second-degree murder, felony hit and run, and driving on a suspended license when she caused the fatal crash.

Chittick noted that Vazquez had two drunken-driving convictions before she killed Winslow a few miles from his home.

In August 2010, just 11 days after the second conviction, Vazquez was caught driving 120 mph on Highway 168 and was arrested by the California Highway Patrol. Though her breath smelled of alcohol, her speech was slurred and she did poorly on a sobriety test, she was never charged in that case.

Chittick scolded Vazquez for ignoring court orders to not drink and drive, but also blamed the criminal justice system: “I regret the court did not do a better job of dealing with her prior offenses.”

Vazquez’s sentence brought an emotional end to a case in which Winslow’s family and friends sat on one side of the courtroom pleading for justice, while Vazquez’s family and friends pleaded for mercy.

During the two-hour hearing, Winslow was described as a family man whose daily routine including checking on his elderly parents before he went to work as a truck driver. Nancy Winslow tearfully described her last telephone conversation with her husband of 28 years: Frank Winslow said he would be home by 3 a.m. “I love you,” he said, before hanging up.

As she spoke, Vazquez shed tears.

Nancy Winslow recalled waking up suddenly at 3:15 a.m and her husband was not by her side. It wasn’t until 6 a.m. that she learned of his death. “At that moment I was sentenced to a lifetime of grief,” she said.

Nancy Winslow said she had to sell the family home because it reminded her of Frank. She and the couple’s two daughters ….MORE

DUI killer had been racking up DUI arrests for years

From Fresno Bee
A Clovis woman was ordered to stand trial Thursday on murder and other charges for an alleged drunken driving accident last October that caused the death of a man who was run off of Highway 168 as he drove home from work.
Perla Ibeth Vazquez faces four charges related to the Oct. 21 death of Frank Winslow. The others are gross vehicular manslaughter while intoxicated, as well as a felony charge of leaving the scene of a fatal collision and driving on a suspended license.
The 25-year-old has two previous drunken driving convictions — one in Tulare County in 2006 and another in Fresno County in 2010. At the time of the accident last October, she also had a pending drunken driving charge from July in which she hit two parked cars near Herndon and Maple avenues in northeast Fresno. Those charges — including DUI and hit and run — are also part of the current case.
Fresno County Superior Court Judge Gary Orozco ordered her to stand trial on nine charges in all. Her next court date is Sept. 4.
Prosecutor Steven Wright said Vazquez…..MORE

VICTIM IDENTIFIED, CHARGES PENDING AGAINST DRIVER

VERNON HOWARD charged with fleeing scene of accident

The Will County Sheriff’s Office reports that it is currently investigating a hit and run fatal accident involving a pedestrian and a vehicle which occurred in Rockdale, IL on Monday night about 10:55pm.  The accident was located on Larkin Avenue, just north of Mound Road.  The victim has been identified as Daniel Lietke, age 31, of the 300 block of Bruce Road in Lockport.

On Monday night Rockdale Police responded to a call regarding a pedestrian being struck by a vehicle in the northbound lanes of Larkin.  Rockdale police contacted the Sheriff’s Office for assistance in investigating the accident.

Witness’ statements indicate that Mr. Lietke was walking along the roadway with a friend when he walked out onto the road and proceeded to lie down on his back in the middle of the lane.  Shortly after, a vehicle traveling north avoided the subject.  The driver of that vehicle stopped a short distance away and was witness to a second vehicle, which was also traveling northbound, run over Lietke.  The vehicle, an Oldsmobile Pacifica, continued north on Larkin away from the scene of the accident.

Vernon Howard charged with hit and run death of Daniel Lietke

Vernon Howard charged with hit and run death of Daniel Lietke

Approximately one hour later Joliet Police spotted the Oldsmobile and conducted a traffic stop without incident.  Four male individuals were inside the vehicle and were turned over to Sheriff’s detectives.  It was determined that two of the passengers were not inside the vehicle at the time of the incident.  One of the passengers however, Mark Pierce, age 26 of Joliet, was subsequently arrested for a Failure to Appear warrant regarding a traffic matter.  The male driver, age 37 of Joliet, was driving on a suspended license.  He is currently being held by the Sheriff’s Office pending formal charges relating to the hit and run.  We anticipate that charges may be filed later today or tomorrow.

Deputy Chief Ken Kaupas stated, “Both the victim and driver of the Oldsmobile had consumed alcohol prior to the fatal accident.  We are awaiting blood test results on the driver and the toxicology report on the victim to determine to what extent alcohol played in this fatal accident.”

New York: Post-Star editorial questions collusion for good ole boy connections of Steven Sharp in DWI charges

$
0
0

The Post-Star newspaper points out that the cops and prosecutors of Washington County, New York can’t be that dumb…there has to be more at play in why a well-connected DWI driver was treated to lesser charges than what an incident in which he was responsible…

We’re skeptical the Washington County district attorney’s office and Washington County Sheriff’s Office are as incompetent as they would have to be to fumble a case the way they did the investigation and prosecution of Steven Sharp.

We’re inclined to believe the offices’ odd passivity when it came to prosecuting Sharp was caused by his connections — he is the son of a retired state trooper and the nephew of a  Washington County sheriff’s administrator — and not by laziness or lack of organization.

Last October, a drunken Sharp rolled his car on Route 196, injuring Malarie Entrup, who was a passenger in the car. The crash cut Entrup’s head and broke her back, collarbone and elbow. She suffered a concussion.

Sharp, 21, from Granville, suffered minor injuries. Police did not charge him at the scene, but awaited results from a blood test.

When it came back, the test showed Sharp’s blood alcohol level was 0.18 percent, more than twice the level for legal intoxication and high enough that he could have been charged with aggravated driving while intoxicated.

But Sharp was charged in May only with driving while intoxicated and was allowed last month to plead guilty to a lesser charge — driving while ability impaired, a noncriminal violation.

He was fined $340 and paid a $260 surcharge. His license was suspended for 90 days, but he was allowed to get a conditional license so he could travel back and forth to work. He had to listen to a victims impact panel.

We hope Sharp did listen and learn from the stories of lives lost and ruined.

We hope he did not take to heart the more obvious lesson of his case: that his family connections allowed him to walk away from a serious crime with a minor punishment.

Sharp’s sentence should have been proportionate to the seriousness of the offense, and it wasn’t.

He should have been charged with aggravated driving while intoxicated and felony vehicular assault. Then, if he had been allowed to plead, he could have pleaded down to no less than driving while intoxicated, and would have faced more severe penalties, including losing his license for six months.

Sharp could have learned a different lesson: that he was going to be held responsible for his actions, despite his family ties. That would have discouraged him from further recklessness.

The irony is the favoritism shown Sharp could hurt him more than it helps him. Because he got off easy, he’s more likely to indulge again in dangerous behavior, and next time he could kill someone.

Both police and prosecutors played games with this case, delaying action until it could be settled, hopefully when no one was paying attention.

Washington County District Attorney Tony Jordan would have us believe the assistant district attorney handling the case was confused about when charges were filed in the case and never checked the record before agreeing to the lenient plea deal.

Washington County Sheriff Jeff Murphy would have us believe he was so unconcerned with a case involving the nephew of one of his top staffers that he “didn’t know” why Sharp was charged with DWI instead of aggravated DWI.

Everyone is shrugging, looking the other way and trying to change the subject.

We believe everything that was done in this case was done intentionally. Prosecutors and police postponed it on purpose and tried to settle it quietly.

But Sharp’s case is out in the open now, and the best we can hope for is that neither the Washington County Sheriff’s Office nor the county District Attorney’s Office allows another case to be handled in the same way.

DUI Checkpoint Nets 4 DUI Arrests, 1 Public Intoxication Arrest, and 14 Citations for Unlicensed Drivers

The Huntington Beach Police Department conducted a Sobriety/Drivers License Checkpoint on Saturday, August 16th, 2014, at Beach Blvd. and Slater Avenue from 7:30 PM to 2:20 AM. Checkpoints are placed in locations that have the greatest opportunity for achieving drunk and drugged driving deterrence and provide the greatest safety for officers and the public. Over the past 12 months, there have been 35 alcohol related collisions on Beach Blvd. These resulted in 14 injuries to the vehicles’ occupants and one fatality. There have also been 241citations issued to drivers on Beach Boulevard for being unlicensed and 66 citations for driving on a suspended/revoked license.

Sobriety/Drivers License checkpoints help lower DUI related deaths and injuries. A major component of these checkpoints in the deterrent effect it has on those who might drive drunk and/or drug impaired, unlicensed, or with a suspended/revoked license. Checkpoints help to bring more awareness to motorists and encourage everyone to use sober designated drivers.

According to the National Highway Traffic Safety Administration (NHTSA), checkpoints have provided the most effective documented results of any DUI enforcement strategies. Here are some of our statistics from Saturday’s checkpoint:

3520 Vehicles through the checkpoint

1129 Vehicles screened and given pamphlet with information on DUI

6 Standardized Field Sobriety Tests administered

4 DUI-Alcohol impaired drivers arrested

1 Public Intoxication Arrest

14 Drivers cited for operating a vehicle while unlicensed

1 Vehicle impounded

12 Citations issued for various code violations

The Huntington Beach Police Department will be conducting another Sobriety/Drivers License checkpoint on September 20th, 2014, in our ongoing commitment to lowering deaths and injuries upon our streets and highways.

Funding for this checkpoint is provided to the Huntington Beach Police Department by a grant from the California Office of Traffic Safety, through the National Highway Traffic Safety Administration, reminding everyone to continue to work together to bring an end to these tragedies. Report Drunk Drivers. Call 911!

Was this an intentional act?

Injured in what may have been an intentional act on the part of Andrew Lanzaro, was Ryan Daniels, 29, of Washington, D.C.  Daniels was in Charleston for the bachelor party of a friend, Drew Sykes, in the role of best man while Plumlee was a groomsman.  The police are investigating reports of a dispute inside the bar between the group and Lanzaro.  Daniels was seriously injured. He went to college in North Carolina and worked on the Obama campaign and then in private industry until last year when he was hired as press secretary for the U. S. Department of Transportation.  His Facebook page shows that he ‘liked’ a gay men’s dance club in Washington.
From Folly Beach Police Department
FOLLY BEACH, S.C. (Sept. 3, 2014) — We had a hit and run this morning (8/30/14) just before 2 am in the 200 block of W. Ashley. A speeding car hit two pedestrians in a group that was walking, and did not stop. The suspect is a white male unknown age, driving a early to mid 2000’s Honda SUV (possibly CRV).The suspect SUV had a spare tire on the rear with a cover that said “HONDA.”The car was a lighter shade of silver or gold. Honda does have a champagne color that could be construed as both. There should be two large dents on the hood, with damage to the headlight/s and or turn signals. Unsure if the windshield was cracked in the collision. After striking the pedestrians, the driver sped away and ran the red light at Center and Ashley to leave the island. Please keep an eye out for the suspect vehicle. Charleston County traffic unit is handling the crash investigation. Obviously we will supplement when and where we can to ensure that we find the suspect. Two pedestrians are severely injured, one of which we are unsure whether or not he will survive. As of 5:30am we still do not have an update on his status from the hospital. Please keep them in your thoughts and prayers.

Palm Desert Police Department Announces Results of DUI / Driver’s License Court Sting Operation

On Thursday, September 4, 2014 between the hours of 7:00 AM to 1:00 PM officers from the Palm Desert Police Department conducted an undercover “Court Sting” operation at the Larson Justice Center located in the city of Indio.  The operation targeted suspected DUI drivers whose licenses were suspended or revoked, or drivers who were unlicensed.

Police officers staked out offenders who had been told by a judge not to drive and/or who had been told of their license suspension.  Nine (9) offenders were followed by officers from courtrooms to their vehicles to ensure that they were not driving.  While some offenders complied with the law and had alternate means of transportation, three individuals in court for DUIs and/or driver’s license violations proceeded to get behind the wheel and drive away from the court house.

Those who chose to drive were stopped by awaiting officers.  Three drivers were arrested for driver’s license violations and their vehicles were impounded.

Those arrested today could face additional jail time, long driver license suspensions, along with other financial hits including attorney fees, court costs, lost time at work, and the potential loss of job or job prospects.

DUI Court Sting stakeout operations, along with regularly scheduled high visibility DUI enforcement, serve as a proven deterrent with the goal of keeping impaired and unlicensed drivers from the road and heightening awareness among the public of the dangers of driving under the influence of drugs and alcohol.

This special DUI operation was funded by a grant from the California Office of Traffic Safety, through the National Highway Traffic Safety Administration.  Report Drunk Drivers – Call 9-1-1!

Friendship, Md. (Sept. 9, 2014) Anne Arundel County Police report that a crash of a sedan took the life of Brian Gore, 33, of Delaware Ave. SW, Washington, D.C., and contributing factors in the crash were alcohol use and speed on the part of the operator.

Police say that  on September 6, 2014, at approximately 19:16 hours, officers from the Traffic Safety Section responded to Friendship Rd near Boyds Turn Rd in Friendship for a report of a single vehicle crash.

The investigation into this crash has revealed that the vehicle, a white 2005 Acura TL four door, was travelling east on Friendship Rd.  Just east of the intersection with Boyds Turn Rd., the vehicle travelled off of the right side of the roadway and into the grass.  Once in the grass, the driver lost control of the car.  The Acura then reentered the roadway and began to spin.  The vehicle then travelled across the roadway and off of the left side of the road.  The Acura then travelled up an embankment and struck a light support pole and a tree before coming to rest.

Gore was taken to Prince Georges Shock Trauma hospital where he died at 1:00 am on Sept. 7, 2014.

The preliminary cause of this crash appears to be driver error.  Excessive speed and alcohol are factors in this crash.  The Traffic Safety Section will be completing the investigation.
