FROM THE CHESAPEAKE TODAY

CLARKSBURG, MD. — One of the traditions of a high school graduation was continued late on Tuesday night in Clarksburg, Maryland when three teen football players died after their truck left the roadway and smashed into a tree.  The scene of human devastation was so severe, police officers were told to turn off their body cameras to prevent recording images of the two dead teens on the scene which could later be viewed by the public.

Montgomery County Police reported that the driver, Jacob Tyler Dennis, 17, of Barnesville Road in Boyds, Md., was killed at the scene of the crash as was one of his passengers, Patrick Andrew Shifflett, 18, of Charlie Farm Court, in Laytonsville, Md.  A second passenger, Cary Maurice Greene, 17, of Muscadine Drive in Clarksburg, Md., was rushed to Suburban Hospital where he died from his injuries received in what has become part of the high school graduation process across America – in spite of the best efforts of parents, community leaders, and law enforcement officials.

Police have the deadly triple fatal crash under investigation and have yet to pinpoint alcohol and speed as factors.

A Maryland State Medical Examiner’s autopsy of the driver will include toxicology reports of the driver to determine what amount, if any, of alcohol or drugs, were present in his system when he drove the large 1989 Ford F-250 off of Burnt Hill Road near Kingstead Road at a fast enough speed at 11:36 pm on June 8, 2016, to end his life and those of his passengers.

Jacob Tyler Dennis entered a guilty plea in District Court in Montgomery County on March 25, 2016, to driving a 2010 Lincoln at twice the legal limit

Pat Shifflett played the offensive line on the second team at Clarksburg High School. The school cancelled various activities set for the next few days and continued with graduation ceremonies at 10 am on June 8, 2016.

Ed Sheahin posted the following on the Clarksburg High School Football Facebook page about Jacob Dennis:

“The US Spirit and tributes to remembering 9/11 were incredible by the Clarksburg community, Blue Brigade, and Coyotes Fans. But I was especially proud of Jacob Dennis, who was the first ever Coyote selected to run out the American flag in pregame. Jacob was selected because of his work ethic in practice. He ended up playing a great deal on defense tonight and held his own against a huge Sherwood offensive line. The wins and losses matter, but years from now It will be the moments of US pride like tonight that will be remembered.”

I set up an Uber account for my son and told him I would come pick him up anytime, anywhere, with no consequences, but as we all know, the drink tends to do the thinking for you, once it is in your system. Add to that the testosterone of a teen boy…. Dangerous combination!!

Sam Ellis will face double DUI rap for deaths of Calvin Li and Alex Murk

JUST ONE YEAR LATER THE CIRCUIT COURT JUDGE GIVES SAM ELLIS A FREE PASS FOR KILLING HIS BUDDIES IN HELL-RIDE

UPDATE:
ROCKVILLE, MD. 06/09/2016— With a guilty plea on the table and a pre-sentence investigation completed, a Montgomery County Circuit County Judge didn’t throw the book at Sam Ellis, he let him off with just serving four years in prison and a suspended sentence on top of that of sixteen years.  Ellis will have to “live with what he did in killing his pals.  He will live with it while he is on travel overseas, off to the beach with his friends, when he plays golf or watches football on TV.  And since this is liberal Montgomery County where the prosecutors had all of Ellis’s friends trying to lie for him and to protect him, even under threat of Grand Jury subpoenas; his lenient sentence could be further water-downed if the Judge decides to “reconsider” the sentence and let him out of jail with an ankle monitor.

ROCKVILLE, MD. — Samuel Joseph Ellis has been indicted by a Montgomery County Circuit Court Grand Jury on seven counts of negligent manslaughter, negligent homicide and causing life-threatening injury for killing Alex Murk and Calvin Li,  two of his high-school friends in a DUI crash in North Potomac last June.

Ellis faces Judge John W. Debelius III on Nov. 20, 2015 for a scheduling hearing.  A video bench warrant hearing was held on Nov. 6, 2015 at 1:30 pm before Judge Cynthia Callahan. Ellis, of 14609 Snapdragon Circle in North Potomac, Md.,

Ellis also faces a criminal hearing on Nov. 18, 2015 in Ocean City from charges brought by Ocean City Police Officer R. Flanagan for being involved in a fight on June 2, 2015. A civil citation for possession of alcohol under the legal age on March 15, 2015 was dropped by Montgomery County States Attorney John McCarthy on June 9, 2015.

Kenneth Saltzman, a parent who was at the party on 14600 Boat House Way in North Potomac, and whom hosted the teen party, was charged on Oct. 28, 2015 with furnishing alcohol to a minor. He faces trial in District Court for Montgomery County on Dec. 10, 2015.

Montgomery County States Attorney McCarthy dumped the alcohol charge

ROCKVILLE, MD. — The driver who police say killed two of his passengers while on a high-speed booze cruise after a teenage drinking party was busy racking up a record of alcohol and fighting in two Maryland counties in recent months.

While Samuel Joseph Ellis, of 14609 Snapdragon Circle in North Potomac Maryland rests up in his hospital bed from injuries which were apparently self-inflicted by his reported speeding into the grounds of a home after a teen drinking party; an examination of his court record shows a civil citation for underage possession of alcohol was served on him by Montgomery County Police Officer N. Culler on March 15, 2015.

The incident of underage alcohol was just three months prior to the fatal crash in which police say he killed two of his school chums. Dead are Alexander Murk and Calvin Jaixing Li, both recent graduates of Wooten High School.

On June 9, 2015, the Montgomery County States Attorney John McCarthy dropped the citation, which carried no criminal record but did have a fine payable of $100.  The court record doesn’t show any public service assessed in lieu of the fine.

On June 2, 2015 the party boy Sam Ellis was reveling in Ocean City, Maryland along with thousands of other newly graduated high school students when he was arrested by Ocean City Police Officer R. Flanagan.  The criminal charge which is pending in Worcester County District Court for a hearing on July 9, 2015 is for the criminal charge of “affray”, which means participating in a fight among several persons, often associated with a riot or rumble.

Arrested at the same time as Ellis was one of the teens who died in the crash, Calvin Jaixing Li, of 2326 McCormack Rd. in Rockville, Md. The pair were charged by Ocean City Police in a June 2, 2015 2:27 am incident which took place at 6007 Coastal Highway.

Court records show that Rockville attorney Brian Clark represented Li and has filed an order with the Worcester County District Court on June 29th for abatement of the charge due to Li’s death.

Montgomery County lawyer and former Delegate Robin Ficker made this comment on aWashington Post article about the double fatal teen crash:

“Just this past week in Montgomery County Circuit Court, Vincent Olalo was sentenced to 3 years in jail by Judge Mason because his drunk driving accident contributed to the death of a man who already had very serious health problems. Let’s see if States Attorney McCarthy administers justice even-handedly.”

Coverage from WUSA9 News

NORTH POTOMAC, Md. Sept. 22, 2015 – (WUSA9) — The family of one of two 18-year-old Wootton High School graduates killed in a car crash after a party released a statement Monday expressing shock about the news a parent was present for the party, and a desire to make sure the laws change.

The statement by David and Pamela Murk comes days after a WUSA9 report into the investigation into the crash that killed their son Alex Murk and fellow Wootton graduate Calvin Li on June 25. The two were killed after the car they were traveling in flew into a fence, hit a tree and landed in a yard.

READ:
The report on the fatal accident

According to documents obtained by WUSA9, the driver of the car, Sam Ellis, was traveling at least more than 30 miles above the speed limit and has a blood alcohol content of .09 two hours after the crash.

“Needless to say, this has been a lot — almost too much — for us to absorb. The details into what happened that night re-opens fresh wounds and our family is absolutely devastated,” David and Pamela Murk said in the statement.

PREVIOUS STORY:
Sources: Parent was at party that led to fatal N. Potomac crash

The two also expressed disgust at the circumstances at the party, specifically the knowledge that a parent was present at the party. According to sources, Kenneth Saltzman knew about the party his daughter was hosting, and at one point jokingly asked a partygoer if one of the 30-packs of beer they brought was for him.

Salzman is expected to be charged with adult responsibility, but the Murks believe punishment associated with that charge is too little.

“What is even more shocking is the fact that under Maryland law, a first offense for behavior such as Mr. Saltzman’s carries no jail time, but merely a maximum fine of $2500,” the Murks said in the statement. “$2500 for something that results in the death of two young men.”

WEB EXTRA:
Read the full statement from David and Pamela Murk.

The two also call for a change to the laws, specifically the potential punishments that can be held against drivers.

“Slaps on the wrist, or short jail sentences, will NOT deter other teenagers from acting as grossly irresponsibly as Sam Ellis did that night,” the Murks said in the statement.

“It goes without saying, we were extremely disappointed that so many family and friends of Alex and Calvin within our community who had knowledge of what took place that evening, were unwilling to come forward without subpoenas and a Grand Jury proceeding,” the Murks said in the statement.

Seaford, Del.- An operator of an ATV driving on a farm field in Delaware on June 12, 2016, was found the following day pinned under his vehicle in a farm ditch and pronounced dead. Delaware State Police report that alcohol played a role in the fatal crash.

The Delaware State Police Collision Reconstruction Unit is currently conducting an investigation of an apparent fatal crash of a man operating an ATV near a tax ditch.

The preliminary investigation has determined the crash occurred on Sunday, June 12, 2016, at approximately 4:22 p.m. at a private farm field on Bethel Concord Road, Seaford. A 2001 Polaris Sportsman 700 four-wheel ATV was operated by a 36-year-old male of Seaford, who was traveling in a north westerly direction on a private farm field along a tax ditch at the rear of the property.

Police say that it appears the ground gave way along the ditch causing the ATV to roll to the right down an embankment approximately ten feet deep. The ATV came to rest on top of the operator who was found underneath the ATV at the bottom of the ditch which contained a very shallow amount of water.

The operator, who was found on Monday, June 13, 2016, at approximately 8:49 p.m., was not wearing a helmet and was pronounced deceased at the scene. Alcohol appears to be a factor.

ANDERSON COUNTY, S.C. 07/04/2016 —A judge set bail for the man charged with hitting and killing two people riding a motorcycle Sunday morning.

Cpl. Bill Rhyne with the South Carolina Highway Patrol office said Jesse Gene Speer, 35, of Anderson, was driving a 2005 Nissan Altima that hit the Harley Davidson from behind, causing the motorcycle to crash.

Speer’s bail was set Sunday evening at $500,000.

In court, he apologized  and cried saying, “I would like to tell the family that I’m sorry … . (I) didn’t know I had hit anybody. Didn’t know what had happened.”

The motorcycle‘s operator and a passenger were both thrown from the Harley-Davidson and died at the scene, Rhyne said. Troopers said neither of the victims was wearing a helmet.

Anderson County Deputy Coroner Don McCown said Bryan Donald Smith and his wife, Shannon Michelle Smith — both 46 — died in the wreck.

Rhyne said the wreck happened around 2:45 a.m. on State Highway 28 near State Highway 24 less than a mile west of Anderson. …MORE

James Garvin said Sunday that he wished he had more time with his friends Bryan Donald Smith and Shannon Michelle Smith.

“My family personally has known them about two years. And I wish 20,” Garvin said. “Shannon was a true angel and gift from above. Bryan to me was special in him just always being Bryan. Day 1 we had this mutual respect for each other and could talk pretty open on most all subjects, even agreeing to disagree.”

Garvin said the Smiths were kindhearted. Shannon Smith helped Garvin’s wife recover after shoulder surgery. Bryan Smith was mechanically inclined and had recently finished rebuilding a water ski to take out on the lake this weekend. Garvin said he was helping Smith get the registration and other papers in order. …MORE

Impaired Driver Strikes and Kills Sterlington Police Officer on US Highway 165

Sterlington, LA—One Sterlington Police Officer was killed and two others injured this morning after an impaired driver struck one of their police cars.

Shortly before 5:00 a.m. on July 3, 2016, Troopers assigned to Louisiana State Police Troop F responded to a fatality crash on US Highway 165 approximately 2 miles south of Louisiana Highway 134 that involved a Sterlington Police Officer.

The initial investigation by State Police revealed three Sterlington Police Officers were conducting a traffic stop on the southbound shoulder of US Hwy 165. Officer David Elahi was standing between the fog line and the rear of his vehicle interviewing a subject when he was struck by a 2014 GMC Sierra driven by 44-year-old Tracy Govan of Monroe, LA. Due to Govan being impaired his vehicle crossed the fog line striking Elahi and two other Officers who were also on scene.

Officer Elahi was pronounced dead at the scene by the Ouachita Parish Coroner’s Office. The other two officers involved were taken to a local hospital with non-life threatening injuries.

At the time of the crash, Govan was determined to be impaired. Govan was arrested and charged with vehicular homicide, vehicular negligent injury, improper lane usage and failure to move over for emergency vehicle on the shoulder.

“Our thoughts and prayers go out to Officer Elahi’s family and the Sterlington Police Department during this time of grief,” said Louisiana State Police Superintendent Colonel Mike Edmonson. “This is a tragedy that could have been avoided.”

This is the second incident in the past two days on Louisiana highways involving a law enforcement officer being struck. A Louisiana State Trooper was struck on I-55 on Friday and suffered injuries while directing traffic around a stalled vehicle.

This is a reminder to everyone to please obey the “Move Over” law! If you see an emergency vehicle stopped on the shoulder with its emergency lights activated, please reduce your speed and change lanes to give first responders room to operate safely. Following this law will help keep first responders safe while they are assisting others on our highways.

Louisiana State Troopers wish to remind motorists that impaired driving continues to be a major problem throughout Louisiana this is especially true on holiday weekends like 4th of July. Whether impaired through alcohol, drugs, or a combination of the two, the consequences of driving while impaired remain the same. Making good choices while in motor vehicles such as never driving while impaired, always ensuring every occupant is properly restrained, and avoiding all distractions can often mean the difference between life and death.

In 2016, Troop F has investigated 19 fatal crashes resulting in 20 deaths.

Louisiana State PoliceVirginia Man Dies in Lafourche Parish Crash

Thibodaux, LA – Louisiana State Police report that shortly before 5:00 a.m. July 2, 2016, Troopers from Troop C began investigating a single-vehicle fatality crash on LA 3107 just west of Rene Drive. The crash took the life of 45-year-old Robert Cook of Front Royal, VA.

The preliminary investigation revealed Cook was driving a 2005 Chevrolet Silverado eastbound on LA 3107. Cook accelerated to pass a vehicle and lost control of his vehicle. He ran off of the road to the left and his vehicle rolled over several times. Cook was not wearing his seat belt and was ejected. He was transported to a nearby hospital where he later died from his injuries. Cook had two passengers inside his vehicle, 56-year-old Craig Uggen and 20-year-old Kriss Uggen, both of Thibodaux, LA. Each passenger was wearing his seatbelt and was transported to the hospital with minor injuries.

Speed and alcohol are suspected as factors in the crash. A blood test for Cook is pending from the Lafourche Parish Coroner’s Office.

Troopers witness this type of tragedy time and time again where some occupants are wearing their seat belts and others are not. We urge all drivers and passengers to insist that everyone wears their seat belt. While not all crashes are survivable, proper use of seat belts can greatly decrease an occupant’s chance of death and may greatly reduce the extent of injury. Louisiana law requires every vehicle occupant, front seat, and back seat, to be properly restrained day or night.

Delaware State Police Say Michael Burns was high-balling and DUI when he crashed into another vehicle

NEWARK, DEL.- The death hour that starts at midnight on most weekends saw yet another suspected booze cruise end the life of a driver who endangered others after a consuming alcohol. The Delaware State Police Collision Reconstruction Unit is currently investigating a fatal motor vehicle crash that occurred early this morning which has claimed the life of a 24-year-old man.

According to Master Corporal Jeffrey R. Hale, the initial investigation has determined that the crash occurred at approximately 12:43 a.m. this morning, Saturday, July 23, 2016, as Natasha Sagapolutele, 29, of Bear, DE, was operating a 2005 Ford Explorer and was attempting to make a left-hand turn from eastbound DE Rt. 4 (E. Chestnut Hill Road), Newark, onto Old Newark Road, Newark.

Police say that as the Ford began to cross the westbound lanes of DE Rt. 4, it was struck on its right hand side by the front of a 2015 Mazda 6, which was traveling at an apparent high rate of speed on westbound DE Rt. 4, and which was being operated by Michael A. Burns, 24, of Newark, DE. The force of the impact caused the Explorer to spin in a counterclockwise direction before coming to rest facing in a southbound direction across the westbound lanes of the roadway. The Mazda continued traveling in a northwesterly direction, striking a curb and then a fence, where it then came to rest.

Alcohol use and speed on the part of Michael Burns is being considered as a factor in the crash.

Michael Burns, who was not properly restrained at the time of the crash, was pronounced dead at the scene. Natasha Sagapolutele, who was properly restrained at the time of the crash, was treated at the scene by New Castle County Paramedics. She was then transported by EMS to the Christiana Hospital where she was admitted for non-life threatening injuries.

Delaware State Police say that this crash remains under investigation by the Delaware State Police Collision Reconstruction Unit. Alcohol use and speed on the part of Michael Burns is being considered as a factor in the crash.

The westbound lanes of DE Rt. 4 were closed for approximately 4 hours as the crash was investigated and cleared.
